Cancellation of GST Registration on Request: New Rule 20
Cancellation of GST Registration on Request: New Rule 20 from 1 November 2026
The Government has introduced a revised procedure for cancellation of GST registration on the taxpayer's request by substituting Rule 20 of the CGST Rules, 2017. The changes, notified through Notification No. 05/2026-Central Tax dated 26 October 2026, aim to simplify cancellation through automated processing, subject to filing of pending returns and payment of outstanding liabilities.
1. Application for Cancellation within 30 Days
Under the substituted Rule 20, a registered taxpayer seeking voluntary cancellation under Section 29(1) of the CGST Act, 2017 must submit an application in FORM GST REG-16 within 30 days from the occurrence of the event requiring cancellation.
The application must include:
-
Details of inputs held in stock.
-
Details of inputs contained in semi-finished or finished goods.
-
Details of capital goods held in stock.
-
Tax liability on such stock and details of payment made, if any.
-
Relevant supporting documents, wherever applicable.
Special relaxation: In the case of the death of a sole proprietor, the 30-day time limit for submitting the cancellation application does not apply. The legal heirs can apply for cancellation.
2. Filing of Pending GST Returns is Mandatory
Before submitting the cancellation application, taxpayers must ensure that all applicable GST returns and statements, including FORM GST CMP-08 wherever applicable, required to be filed up to the proposed effective date of cancellation have been furnished.
Additionally, where FORM GSTR-1 or the Invoice Furnishing Facility (IFF) has been furnished for a particular tax period, the corresponding FORM GSTR-3B must also be filed before applying for cancellation.
This condition is important because taxpayers cannot obtain cancellation merely by submitting REG-16 while leaving mandatory returns pending.
3. Registration Remains Suspended During Cancellation Proceedings
Once FORM GST REG-16 is submitted, the GST registration will remain suspended until completion of the cancellation proceedings.
During this period, taxpayers should take note of the suspension status and applicable restrictions on making taxable supplies.
4. Automatic Cancellation Through the GST Portal
One of the major changes introduced under the new Rule 20 is the provision for system-based automatic cancellation without manual intervention by the GST officer.
Automatic cancellation will be available when:
-
All applicable GST returns have been furnished within the prescribed time.
-
All outstanding tax, interest, late fees, penalties and other payable amounts have been paid.
-
Either of the following conditions is satisfied:
1. The output tax liability on supplies made to registered persons, as declared in GSTR-1 (including amendments through GSTR-1A, wherever applicable) or IFF, does not exceed Rs. 2,50,000 in any month from the date of registration up to the date of cancellation application.
2. The taxpayer furnishes the final return in FORM GSTR-10 within three days from the due date of the remaining returns referred to in Rule 20(3), wherever applicable.
Once these conditions are fulfilled, the GST portal will electronically cancel the registration and communicate the cancellation through FORM GST REG-38.
5. Cancellation by Proper Officer Within 15 Days
If the application does not qualify for automatic cancellation, it will be forwarded to the proper GST officer for examination.
The revised procedure provides the following timelines:
-
The officer must examine the application within 15 days of receiving it.
-
If the application is deficient, the officer may issue a notice in FORM GST REG-03.
-
The taxpayer must submit the required clarification or documents in FORM GST REG-04 within 15 days of receiving the notice.
-
If the officer is satisfied with the reply, cancellation can be approved within 15 days of receiving the reply.
-
If the officer fails to take action within 15 days of receiving the application or the taxpayer's reply, as applicable, the application shall be deemed approved.
The cancellation order will be communicated electronically in FORM GST REG-19.
6. What Should Taxpayers Do Before Applying?
Businesses intending to close their GST registration should take the following precautions:
-
File all pending GSTR-1 and GSTR-3B returns.
-
File applicable GSTR-4 or CMP-08 statements, wherever relevant.
-
Clear outstanding GST tax, interest, late fees and penalties.
-
Calculate the tax liability on closing stock and capital goods.
-
Keep supporting documents ready for submission with REG-16.
-
Check whether the business qualifies for automatic cancellation.
Conclusion
The substituted Rule 20 of the CGST Rules, 2017, effective from 1 November 2026, introduces a more streamlined mechanism for cancellation of GST registration. The provision for automated approval and deemed approval within 15 days is expected to reduce procedural delays and make the cancellation process more efficient.
Taxpayers planning to discontinue their businesses or surrender GST registration should ensure that all compliance requirements are completed before submitting FORM GST REG-16.
